If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Nicki Hoyne’s relationship with you in relation to this website and your purchases. At no point are your statutory rights affected.

The term ‘Nicki Hoyne’ or ‘us’ or ‘we’ refers to the owner of the website www.nickihoyne.com which is wholly owned by Nicki Hoyne a registered trademark. The term ‘you’ or ‘your’ refers to the user or viewer of our website.

Ordering Products

We reserve the right to refuse service to anyone for any reason at any time.

Products displayed on our website can be ordered securely online through a 256 bit encrypted secure server. We accept Paypal, the following credit & debit cards – MasterCard, Visa, American Express. All options can be selected during the checkout process. Once you’ve placed your order and provided a valid email address you will receive an email order confirmation and a receipt of your credit/debit card transaction.

Gift Vouchers 

Nicki Hoyne Gift Vouchers can only be exchanged for products on our website (https://www.nickihoyne.com). A gift voucher cannot be exchanged for cash or refunded. If the products purchased online total less than the value of your gift card, any balance will be left as credit for you on your gift voucher. If the products purchased online total less than the value of your voucher, then it will not be possible to process your order until you have inputted payment information (Credit Card or Paypal). When redeeming a gift voucher on our website you will be required to give the gift voucher code on the gift voucher which is emailed to the you separately to your order confirmation. Please keep your voucher code safe. If your gift voucher becomes accidentally damaged or lost or if you have any issues please contact us with information on the purchase date and purchasers email address.

Shipping

Order by 11.30AM MONDAY 16TH DECEMBER for GUARANTEED CHRISTMAS DELIVERY Worldwide.

Order by 11.30AM THURSDAY 19TH DECEMBER for GUARANTEED CHRISTMAS DELIVERY for Ireland & UK.

After this time orders placed may arrive in time but there is no guarantee.

Christmas Closing: Any Orders placed after 11.30am Friday 20th December will be dispatched from 2nd January 2024.

Our daily cut off is 11.30am Monday to Friday. Orders placed before that time will dispatch that day. Orders placed after that time will dispatch the following day.

Orders dispatch within 48 business hours.

Unfortunately, it is not possible to make any amends to your order once your order has been placed.

All Orders are shipped via courier. You will receive an email/text to confirm dispatch with your tracking number.

Any items purchased with a pre-order item will not dispatch until the pre-order dispatch date.

Cancellations

If you wish to cancel your order please respond to your confirmation email requesting cancellation or email us at hello@nickihoyne.com quoting your order number.

If your order has not dispatched we will cancel your order and issue a refund. If your item has dispatched it will then fall under our returns policy as stated below.

Returns

Any item purchased from 11th November to 24th December can be returned up to Friday 10th January 2024. For purchases made from 25th December onwards, our normal returns policy will apply. 

Returns are only valid when we are notified and the item is returned within 14 days of receipt.

Items must be returned unworn and repacked in their original packaging. Shoe Soles must be UNSCUFFED.

Returns Form must be included in the box and must include your ORDER NUMBER. The form provides instructions to ensure we correctly process your return. Please email us hello@nickihoyne.com to request a returns form. 

Not including the returns form may result in delays, errors in your return or our inability to process the return. 

The goods must be packed with sufficient outer packaging to ensure that no damage is caused in transit. We will not be responsible for such damage and would suggest you take out insurance with your delivery service to cover this.

You are responsible for all costs of returning items to us. You must use a reputable delivery service that can provide evidence that they have delivered the goods back to us. 

The return address may not be the same address from which the goods were sent.

For International Returns please note "RETURNS, NO COMMERCIAL VALUE" for customs declaration. 

Assuming that our return’s policy has been adhered to, returned goods will be credited within 14 day of our receiving them. 

Any gift with purchase must also be returned in its original packaging. If the gift is not returned the value will be deducted from the refund.

If in doubt about any aspect of our returns policy, please contact us and we will be happy to help.

Unsuccessful Delivery

On the rare occasion that delivery is unsuccessful and the goods are returned to us. Redelivery of a returned order will take place following payment of the return and new delivery costs.

Damaged/Incorrect Items

All items are Quality Checked before dispatching our warehouse

If you do receive an item that has been damaged or is incorrect, please email us within 48 hours of receipt detailing your order number and a description of the damage or incorrect item(s) to hello@nickihoyne.com.

After 48 hours, your item will fall within the 14-day returns policy.

Damaged/Incorrect items must be returned unworn and repacked in the original packaging. 

Secure Trading

All orders taken on our site are handled by a secure server which means that all your personal information is encrypted before it is sent and then only we can read it.

You can verify the secure status of our server in a number of ways:

1. By default most browsers put up an alert window advising you that you are about to enter a secure site.
2. A closed padlock symbol will appear in the status bar of your browser, the address bar on your browser many also turn indicating that this is a secure website.
3. The web address in the address bar will commence with https:// instead of http:// The additional ‘s’ signifies secure.

The information you transmit is encrypted using 256 bit SSL (Secure Socket Layer) technology, currently the most sophisticated encryption method available for public use. The confidentiality and security of your personal information is of paramount importance and we hope that the measures we have taken to protect it demonstrate this. We welcome any form of feedback to help us to improve the service we offer. If you have a complaint regarding any aspect of the Nicki Hoyne brand please contact us. We endeavour to respond to all complaints within 5 working days. We will keep you informed as we handle your complaint and will, in most cases, be able to resolve this within 30 days.

Force Majeure

Nicki Hoyne shall have no liability for any failure to deliver goods, any delay in delivery or for any damage or defect to goods caused by any of the following events or circumstances beyond its reasonable control: Acts of God, flood, riots, fire, drought, war or legislation. Accuracy of Information This website may include unintentional inaccuracies or typographical errors, for which we apologise. Nicki Hoyne reserve the right to make changes in the products, prices and content described in this website at any time and without notice. We reserve the right to not supply goods and to cancel your order in the event of a pricing error or omission. We reserve the right to withdraw any item from sale, at any point prior to dispatch, for whatever reason.

Limitation of Liability

Nicki Hoyne shall not be responsible for any detrimental reliance you place on this website or its contents. We endeavour to make our website uninterrupted and error free, but are reliant on our web server. Therefore, the online shopping service is provided on an “as is” and “as available” basis. Any other information or advice given on this site is meant for guidance purposes only and purchasers must be responsible for determining whether such information or advice applies to their particular circumstances. The information and advice contained in this website should not be relied upon as statements or representations of facts. No warranty is given as to the accuracy of any information given. Nicki Hoyne is not liable for any allergies or accidents caused by the products we sell.

Governing Law

This agreement between Nicki Hoyne and you shall be governed by and interpreted in accordance with Irish law, and Irish courts shall have jurisdiction to resolve any disputes. All rights, including copyright, trademarks, names and logos, used in relation to this website are owned by or controlled for these purposes by us. Nothing in this agreement confers on you any license or right under any of our trademarks, names or logos or those of any third party. We reserve the right to issue legal proceedings against any companies or persons who copy any text, photographs, images, graphics, logos, button icons, trademarks or any part of this website. The content of this website is and remains the intellectual property of Nicki Hoyne.

COMPETITION TERMS & CONDITIONS

 

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the terms and conditions and by participating all claimants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

 

• The Promoter: Nicki Hoyne brand.
• The Supplier: Please see each individual promotion for details of the prize supplier.
• Eligibility: This prize promotion is open internationally to NYONE aged 18 years or over, excluding employees and their immediate families (spouse, parent, child, sibling, grandparent and/or “step” family), of The Promoter, associated agents or anyone professionally connected with the prize promotion.
• Promotional Period: Please see each individual promotion for its prize pool.
• Entry Instructions: Please see the individual prize promotion for entry details.
• Only one entry per person per prize promotion unless otherwise stated in the individual promotion. All additional entries will be disqualified.
• Any entries that the Promoter consider (in our absolute discretion) to be dangerous, vulgar, offensive, indecent, illegal racist, copied, offensive, cruel or fraudulent, or infringe on the rights or copyright of others will be immediately disqualified.
• No third party or bulk entries. If it becomes apparent that either a participant or household is using any means to circumvent this condition such as, and without limitation, multiple email accounts, multiple reproduced or computer-generated entries, using multiple identities, fraudulently falsifying data, acting fraudulently or dishonestly in the opinion of the promoter or otherwise acting in violation of these terms, these participants will be disqualified, and any prize entitlement will be void.
• Incomplete, illegible, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery or receipt. No responsibility can be accepted for entries that are incomplete, lost due to technical reasons, corrupted, delayed, wrongly delivered, or not received for whatsoever reason.
• Prize Fund: Please see each individual promotion for its prize pool.
• Winner Selection: Prize draw winner (s)will be randomly selected by a computerised random generator from all entries. Skills based entries shall be judged based on the judging criteria, set out in the promotion, by a panel which shall include one judge independent to the Promoter.
• Winner Notification: The winners will be notified by direct message or email via the account provided at point of entry within 14 days of the closing date and will have 14 days from notification to claim their prize. If a winner does not claim their prize within this timeframe the promoter reserves the right to withdraw prize entitlement and will award the prize to a reserve drawn at the same time as the original.
• It is the responsibility of the entrant to provide correct, up-to-date details when entering the prize promotion and acceptance of the prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.
• General: Promoter’s decision is final and binding. No correspondence will be entered into. Entry implies acceptance of these terms and conditions.
• Prizes must be accepted as offered by the named winner. There is no cash or alternative prizes, in whole or part. The prizes are not transferable and cannot be resold.
• The Promoter reserves the right to substitute a prize of equal or greater value should circumstances outside its control make this necessary.
• The Promoter reserves the right to verify winners and ask for proof of identity, age and address and to withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions.
• You agree that if you are a winner, you will take part in and co-operate fully with reasonable publicity and to the use of your name, photograph and any comments in such publicity without any fee being payable.
• By entering the Promotion, each entrant grants the Promoter a world-wide, perpetual, irrevocable, non-exclusive, transferable, royalty free and sub-licensable right and licence to use reproduce, modify, adapt, publish or display (in whole or in part) any intellectual property contained in the content of their entry, without royalty, payment or other compensation. Each Entrant agrees not to assert any moral rights in relation to such use and warrants that they have full authority to grant such rights.
• The name and country of the winners can be obtained by sending an email, 28 days after the prize promotion closing date, to hello@nickihoyne.com.
• The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these terms and conditions or the spirit of the Promotion. Those who try to circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.
• Entry into the Promotion is at the entrant’s sole risk. To the extent permitted by law, neither the Promoter nor Supplier accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter and Supplier further disclaim liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these terms and conditions shall act to limit or exclude the Promoter and Supplier’s liability resulting from its negligence or fraud.
• If for any reason, the Promotion is not capable of running as planned for reasons (including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.
• If an act, omission, event or circumstance occurs which are beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.
• The Promoter accepts no responsibility for system errors or other issues that may result in disruption to, lost, delayed or not received entries, winner notifications or prizes. The Promoter, the Supplier or its agencies will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of The Promoter or its agencies.
• Where a prize is provided by a Supplier, the Promoter accepts no responsibility for inaccuracy of any prize description, and The Supplier is responsible for prize fulfilment.
• If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
• The Promoter and the Supplier reserve the right to cancel, amend, withdraw, terminate or temporarily suspend this promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment.
• The decisions of the Promoter are final and binding in all matters relating to the Promotion and no correspondence will be entered into.
• The Promotion and these terms and conditions, and any disputes arising therefrom, shall be subject to Irish law and the exclusive jurisdiction of Irish Courts.
• Data Protection: Any personal information that entrants share with the Promoter will be kept secure and only used in line with these terms and conditions unless the entrant has opted in to future marketing from the Promoter and/or the Supplier. By entering the promotion, entrants agree that their information may be used by the Promoter to administer the promotion and winners consent to give their name and county for the winners’ list.
